Lot 283.  4 Original Court “Exhibits” from an Early 1900s Coca-Cola Patent Case. About 1910, the Gay-Ola Company began marketing a product allegedly made with the same formula as Coca-Cola. Coke sued Gay-Ola for patent infringement. In its suit, Coke made various charges. Among them, Gay-Ola allegedly offered to undercut Coke’s price to its bottling companies and encouraged the bottlers to pass Gay-Ola off as Coke. The case was adjudicated by the U.S. Circuit Court of Appeals, Sixth Circuit, and then appealed to the U.S. Supreme Court. The parties settled before the court handed down its decision. Four exhibits from the appeal to the Supreme Court came from the estate of one of the attorneys involved in the case. Exhibits A and B both carry the official seal of the U.S. Patent Office and apparent original signatures of J. F. Newton, Commissioner of Patents. Exhibit A, dated Sept. 19, 1914, certifies that Coca-Cola registered its trademark on May 14, 1892. Exhibit B, dated July 17, 1915, certifies that Coke registered its label on Sept. 24, 1907. A notarized copy of the label is attached. Exhibit C is a 2 ¼” x 7” rendering of a Gay-Ola bottled, which is described in one court decision. Exhibit D is a copy of the U.S. Court of Appeals, Sixth Circuit, decision. The front pages of Exhibits A and B have some stains and chips to the seals. Exhibit D is separated at the spine and has tears along the folds. This documents represent a interesting and significant chapter from the history of one of the country’s most venerable companies.
